The startup xAI, founded by Elon Musk, has initiated a lawsuit in federal court in California against OpenAI. The plaintiffs claim that OpenAI employs an aggressive strategy to poach employees in order to gain access to confidential data and technological solutions related to the development of the Grok chatbot.

In its complaint, xAI alleges that OpenAI is deliberately seeking specialists with in-depth knowledge of the source code, data center infrastructure, and business plans of its competitor. According to the company, employees who transition to OpenAI are obligated to maintain confidentiality under signed non-disclosure agreements, yet they transfer protected information to their new employer.

xAI uncovered these violations during an investigation into former engineer Shuechen Li, who is accused of transferring confidential materials from OpenAI. As of the time of this report, Li had not provided an official response to the allegations.

In addition to Li, xAI reported the transition of two other former employees to OpenAI — engineer Jimmy Freytag and an unnamed top executive from the finance division.

In a separate statement, xAI also accused Apple of collaborating with OpenAI to limit competition in the artificial intelligence market. Meanwhile, Apple has not commented on these allegations.

This lawsuit marks another episode in the ongoing conflict between Musk, OpenAI, and their partners in Silicon Valley. Elon Musk previously filed a lawsuit against OpenAI, accusing the company of straying from its original mission and excessive commercialization. In response, OpenAI has made counterclaims, pointing to misconduct on Musk’s part.

Earlier, the xAI team also initiated a lawsuit against Elon Musk himself and his company, indicating complex legal relationships even within the project.
