OpenAI has won a court case against Elon Musk’s xAI regarding allegations of employee poaching and breach of trade secrets.

The Court Found No Violations by OpenAI
District Judge Rita F. Lin ruled on February 24, 2026, to dismiss xAI’s lawsuit, citing a lack of compelling evidence of wrongdoing by OpenAI. The court allowed xAI the opportunity to file an amended complaint with clearer arguments and evidence, but the current claims were deemed unfounded.
In the case materials, xAI noted that eight of its employees transitioned to OpenAI almost simultaneously and suggested a possible leak of code and data. However, as the judge emphasized, it was not proven that OpenAI was involved in or encouraged these actions.
Specific incidents involved xAI employees retaining work chats on personal devices, refusing to provide confidentiality documents after termination, and attempts to access internal information after joining OpenAI. The court concluded that these instances did not substantiate illegal behavior by OpenAI itself.

This case is part of a larger legal confrontation between OpenAI and Elon Musk, who is a co-founder of OpenAI and the founder of xAI. In recent years, the dispute between the parties has intensified and gained public attention.
