EU Considers Extension and Update of Protection Rules for Ukrainian Refugees

The European Union has begun discussions regarding the future of the legal protection mechanism for Ukrainian refugees who have sought shelter in EU countries due to the full-scale war initiated by Russia. The Temporary Protection Directive, adopted in March 2022, initially allowed for only two extensions — up to three years, meaning until March 2025. Later, this period was extended to March 2026.

Possible Scenarios for Further EU Decisions

Currently, European ministers are considering extending the existing regime for another year. It is expected that such a decision may be accompanied by a special statement from member countries regarding the gradual lifting of temporary protection. Key discussions will take place during the EU Council meeting on justice scheduled for June 12-13. Most EU member states support the extension of protection, but there are few legal mechanisms available for this. Additionally, the burden on national asylum systems is increasing.

Searching for a Strategy for the Future

The EU aims to develop a comprehensive strategy to transition from the current temporary protection regime. This strategy should take into account the interests of both Ukrainians who plan to remain in the EU and those who intend to return home. Among the possible options being considered is narrowing the scope of the existing directive. Another scenario is to leave everything unchanged, although this carries significant risks and substantial financial costs. Also, although unlikely, there is discussion about the possibility of creating a new legal mechanism to protect Ukrainian citizens.
