Kyiv Updates Rules for Reserving Employees: Key Changes and New Requirements

The Cabinet of Ministers of Ukraine has approved changes to the rules for reserving military personnel of critical enterprises during martial law. According to Resolution No. 692, which the government adopted on May 30, all enterprises with such status must re-confirm their compliance with the updated criteria.

Updating the Status of Critical Enterprises: Deadlines and Procedure

The status of a critical enterprise granted earlier will remain valid only until the expiration of its term, but no later than September 1, 2026. By this time, each enterprise must undergo verification according to the new requirements.

By June 10, central and local authorities must update the criteria for determining critical companies. Verification of those enterprises that currently hold the relevant status must take place by July 1. If discrepancies with the new criteria are found or if specific grounds for granting the status are revoked, that status will be annulled. The government plans to complete the review of all decisions by September 1, 2026.

“If during the review it is found that the enterprise no longer meets the criteria or the criterion under which it was previously recognized as critical has been revoked, the status will be annulled.”

Salary Requirements and Reservation Features in Frontline Regions

From now on, for reserving employees, the enterprise must ensure an average salary of no less than three minimum wages, which is 25,941 hryvnias per employee, starting from September 1. For companies operating in frontline areas, this threshold is reduced to 2.5 minimum wages, or 21,618 hryvnias.

The changes also concern the accounting of employees. From now on, only those employees who work at their primary place of employment will be counted towards the reservation quota. Part-time workers and those who already have a deferment from mobilization for other reasons will only be considered based on their primary employment.

Enterprises must submit information through the “Diia” system about employees for whom the reservation has been canceled within ten days.

If a company exceeds the quota for reserved employees, this may be grounds for losing the status of a critical enterprise. At the same time, separate benefits have been maintained for enterprises in frontline regions and drone manufacturers, allowing them to reserve a larger number of specialists for continuous operation.
